May 9. 2022 The monopoles are down!

Palm Beach Code Enforcement Board ordered the homeowners along North Ocean Blvd to remove all monopoles by May 9th. 2022 and pay a fine.

The wooden monopoles were removed - and environmentally challenging plastic cones were set in their place.

ONCE AGAIN - Thank you for your letters and your appearance at the Palm Beach Code Enforcement Board Meeting - it was a great success!

It was a big victory for beachgoers in favor of open and free use of the beach. After a nearly two hour “trial”, the Board voted unanimously to enforce the removal of the homeowner installed monoposts in the dry sand.

The Board found the issued citation under existing Town Code Section 134-2 to be correct and instructed the homeowner by May 9. 2022 to remove the posts and other barriers installed without a permit.

While this hearing was all about enforcing the law it was not lost on the Board Members through letters they received in advance and public testimony that we, the public was not pleased with the restrictions and behavior of the violator.

Letting our Town Officials know how concerned you are about the poles, ropes, cones installed along the beach heading to the waters edge - and - the strategically planted sea oats that create a fence, a barrier to stop folks from walking across the dry sand is vital to the Town’s understanding of this dire situation.

The tactics of the homeowners along North Ocean Blvd, coupled with beach erosion have made the beach unusable at times, not to mention unsightly.

Sovereignty Lands

The title to lands under navigable waters, within the boundaries of the state, which have not been alienated, including beaches below mean high water lines, is held by the state, by virtue of its sovereignty, in trust for all the people. Sale of such lands may be authorized by law, but only when in the public interest. Private use of portions of such lands may be authorized by law, but only when not contrary to the public interest
